On behalf of The Nation magazine, we won a precedent-setting ruling from the United States Court of Appeals for the D.C. Circuit regarding the extent to which the government may refuse to identify the existence of documents concerning individuals. The case involved records on the ways in which Ross Perot had participated in U.S. covert foreign policy initiatives. The court held that the government may not, on privacy grounds, uniformly refuse to process FOIA requests for investigatory records concerning individuals.
