Public Employees for Environmental Responsibility v. Bromwich, Civ. No. 10-1067

Case Summary:

On behalf of Public Employees for Environmental Responsibility, several other environmental organizations, and three individuals, we challenged the decision of federal agencies to authorize the construction and operation of 130 wind power turbines, a massive transformer station, and electrical cables in federal waters off the coast of Massachusetts.  The project, as designed, will kill thousands of federally protected birds and may harm critically imperiled North Atlantic Right Whales.  Our lawsuit, brought under the Endangered Species Act, the Migratory Bird Treaty Act, and the National Environmental Policy Act, seeks to compel the agencies to scrutinize the project and make independent determinations on what measures – such as temporary seasonal shutdowns – are necessary to protect wildlife.

Plaintiff: Public Employees for Environmental Responsibility, Cetacean Society International, Lower Laguna Madre Foundation, CAlifornians for Renewable Energy, Three Bays Preservation, Alliance to Protect Nantucket Sound, and individuals.
