People for the Ethical Treatment of Animals v. National Institute of Health, Civ. No. 10-1818

Case Summary:

We challenged the federal government’s refusal to provide People for the Ethical Treatment of Animals records pursuant to the organization’s Freedom of Information Act (“FOIA”) request.  Rather than provide records on whether the National Institutes of Health is conducting an investigation into fraudulent research, the misuse of federal funds, and violations of the Animal Welfare Act and the Public Health Service’s Policy related to animal experiments at Auburn University – as required by FOIA – the government refuses to confirm or deny whether it even has records related to an investigation.  Our lawsuit seeks to compel the government to produce all responsive records in its possession.
