Humane Society of the United States v. Johanns, 520 F. Supp. 2d 8 (D.D.C. 2007)

Case Summary:

We represented the Humane Society of the United States, the Animal Welfare Institute, and other plaintiffs in a suit against a Department of Agriculture (USDA) regulation that permitted horse slaughter plants to pay for the costs of USDA inspections. The regulation was designed to subvert a recent federal law intended to halt horse slaughter by defunding these inspections. The district court found that the regulation had been issued in violation of the National Environmental Policy Act and enjoined its implementation.  An appeal by the horse slaughter plants was dismissed by the D.C. Circuit.
