Biodiversity Legal Foundation v. Babbitt, Civ. No. 96-1156, 1997 U.S. Dist. LEXIS 23007 (D.D.C. March 27, 1997)
Case Summary:
On behalf of the Biodiversity Legal Foundation and two scientists, we successfully challenged the Fish and Wildlife Service's failure to initiate the listing process for the Southern California Mountain Yellow-Legged Frog, a desperately endangered species. The United States District Court for the District of Columbia ruled in our favor, holding that the Service could not rely on its own "listing priority guidance" as an excuse for not responding to the listing petition within the statutorily required 90 days.
Plaintiffs: Biodiversity Legal Foundation, and individuals.
Court: United States District Court for the District of Columbia
